1. Service Description
RefundSweep ([hereinafter referred to as "we," "us," or "our"]) provides a service designed to identify and facilitate the recovery of potential shipping refunds from various shipping carriers for e-commerce merchants ([hereinafter referred to as "you" or "your"]). Our service automatically monitors your shipping data, identifies eligible refund opportunities based on carrier policies, and initiates the refund claim process on your behalf. We do not guarantee the success of any refund claim, as final approval rests with the respective shipping carriers.
2. Pricing
Our service operates on a "no-win-no-fee" basis. We charge a success fee of 25% (twenty-five percent) of the total amount successfully refunded to your account as a direct result of our service. If no refund is obtained, no fee is charged. Fees will be automatically deducted from your connected payment method or directly from the recovered refund amount, as per your authorization.
3. Merchant Authorization
By using RefundSweep, you authorize us to access your shipping account data (e.g., tracking numbers, shipping costs, delivery statuses) from your connected e-commerce platforms and shipping carriers. You also grant us explicit permission to act as your authorized agent for the sole purpose of submitting refund claims and communicating with shipping carriers on your behalf. You represent and warrant that you have the necessary rights and permissions to grant us such access and authorization.
4. Carrier Policy Disclaimer
RefundSweep's ability to secure refunds is entirely dependent on the current and evolving policies of individual shipping carriers (e.g., FedEx, UPS, USPS, DHL). These policies can change without prior notice, and certain refund types may be subject to specific conditions, time limits, or exclusions. We are not responsible for any changes in carrier policies that may affect the eligibility or success of refund claims.
5. Liability Limits
To the maximum extent permitted by applicable law, RefundSweep shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the service; (b) any conduct or content of any third party on the service; (c) any content obtained from the service; and (d) unauthorized access, use, or alteration of your transmissions or content. In no event shall RefundSweep's aggregate liability for all claims relating to the service exceed the greater of one hundred U.S. dollars (U.S. $100.00) or the amount you paid RefundSweep, if any, in the last six months for the services giving rise to the claim.
6. Termination
You may terminate your account and discontinue use of our services at any time. We reserve the right to suspend or terminate your access to the service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms of Service. Upon termination, your right to use the service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
7. Governing Law
These Terms shall be governed and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our service, and supersede and replace any prior agreements we might have between us regarding the service.
